PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. HotBox Monthly provides its products and services to you through its website location at www.hotboxmonthly.com. By accessing and/or using the website, completing the registration process, ordering a subscription box, purchasing products or using the services, you understand and agree to accept and adhere to the following terms and conditions as stated in this policy (hereafter referred to as ‘User Agreement’). We reserve the right to change this User Agreement from time to time without notice. You acknowledge and agree that it is your responsibility to review this User Agreement periodically to familiarize yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgment and agreement of the modified terms and conditions. If you do not agree to these terms and conditions, please do not use this site.

By accessing or using the website, you confirm that you are 18 years of age and older and aware of all local, state and federal laws regarding the possession or carrying of the products you are ordering and/or included in your subscription box.

Terms and Conditions:

All customers must agree to HotBox Monthly’s statements and terms of sale before a subscription box or order is placed. All orders are subject to review and approval by HotBox Monthly.

Website Use Not for Individuals Under the Age of 18

The HotBox Monthly website is available to registered and unregistered users who are 18 years of age and older and who have not been suspended or removed by HotBox Monthly for any reason. HotBox Monthly reserves the right to revoke the ability to access the products and services offered on the website for any reason at any time, including as a result of a violation of this User Agreement or the Privacy Policy, without notice. Use of the website is void where prohibited by law.

The Monthly Subscription Contract Between You and HotBox Monthly

HotBox Monthly offers a rebillable monthly subscription (“Monthly Subscription”). By purchasing a Monthly Subscription, you acknowledge that your subscription has an initial and recurring payment feature, and you accept responsibility for all recurring charges prior to cancellation. Your subscription will be automatically extended for successive monthly periods and your payment method will automatically be charged for each successive monthly period at the then-current selected subscription rate. Your credit card will be charged on the 20th of each month and your HotBox Monthly will be shipped the following month. HotBox Monthly will charge the credit card you used to create your Monthly Subscription or as otherwise directed by you.

To cancel your Monthly Subscription at any time, you may do so by logging into your HotBox Monthly account or by emailing us at info@hotboxmonthly.com.

Purchases:

All payments on our website are processed immediately. If you sign up for a Monthly Subscription, you will be charged on the day you sign up. Your reoccurring charges will take place on the 20th of each month after the first month you subscribe.

We do not ship to any other area within the United States where we are prohibited by federal, state, or local law to ship a product. You understand that if you attempt to have a product shipped to these restricted areas, your order will be canceled.

Modifications to HotBox Monthly Monthly Subscription

HotBox Monthly reserves the right to modify or discontinue, temporarily or permanently, the HotBox Monthly Monthly Subscription (or any part thereof) with or without notice. You agree that HotBox Monthly will not be liable to you or to any third party for any modification, suspension, or discontinuance of the subscription.

HotBox Monthly Returns & Refunds

HotBox Monthly is committed to 100% customer satisfaction. Our return policy is simple. If you’re not 100% satisfied with your purchase, you may send it back for a full refund.

We will accept returns for Monthly Subscription box items (in whole or in part) as well as non-Monthly subscription box items. All refunds will be applied to the credit card used for the original purchase. You should allow one to two billing cycles for the refund to appear on your statement.

Release of Liability and Agreement to Indemnify and Defend

You hereby release HotBox Monthly, its owners, agents, officers, and employees from damages, rights, claims, and actions of any kind including, without limitation, personal injuries, death, and property damage, that is either directly or indirectly related to or arises from your purchase of any products. You also acknowledge that you are responsible for how you use the product and any third-party use. In the event that any other party files a claim of any kind against HotBox Monthly, you will indemnify and pay to defend HotBox Monthly and its owners, agents, officers, and employees against any resulting civil liability or criminal prosecution.

Errors and Omissions

HotBox Monthly makes every effort to have accurate and complete information on our site, including but not limited to pricing, availability, and product features, however, we occasionally make mistakes. Customer agrees that they will not hold HotBox Monthly liable for such mistakes or omissions and acknowledges that orders may be canceled after the fact due to errors or omissions.

We strive to ensure we follow all legal restrictions across the United States when shipping our products. We are constantly investing in ensuring we do not mistakenly or inadvertently ship any restricted items. If you receive an item that you believe is a restricted item in your jurisdiction, please contact us immediately so we can work to resolve the matter.

Agreement to Indemnify and Defend for Misrepresentation

In the event that any of the above statements are determined to be untrue, you agree to indemnify and defend HotBox Monthly, and its owners, agents, officers, and employees against any resulting civil liability or criminal prosecution.

Jurisdiction

You agree that if you, or someone else affected by your use of any product purchased from HotBox Monthly, brings a legal claim of any kind against HotBox Monthly, or any of its owners, agents, officers, or employees, that such legal action must be filed in any appropriate State Court in Butler County, Ohio. You also agree that any complaints filed within any other jurisdiction shall be immediately terminated and moved to any appropriate State Court in Butler County, Ohio, and agree to reimburse HotBox Monthly and its owners, agents, officers, and employees for any costs they may each incur in defending against the complaint or effecting its removal until such time that the complaint is properly filed in any appropriate State Court in Butler County, Ohio.

SHIPPING AND RETURNS

HotBox Monthly ships through the United Postal Service (“UPS”).  Your HotBox Monthly will ship in the middle of the month. You must sign up before the last day of the month to get the next month’s HotBox Monthly. (For example, you must sign up in March to get the April HotBox Monthly).

Once your product is received by the UPS, you will automatically assume all responsibility for its safe transit to your delivery address, and thereafter. You also agree to hereby explicitly release HotBox Monthly from all liability and responsibility thereafter.

HotBox Monthly does not ship outside the continental United States.

Order Cancellation

If an order has been submitted and payment has been processed, HotBox Monthly will still accept your order cancellation. Your refund will be applied to the credit card used for the original purchase. Please allow one to two billing cycles for the refund to appear on your statement. Customer loyalty and 100% customer satisfaction is our goal.

Refusal to Accept Delivery

When an order is placed with HotBox Monthly, the customer agrees to accept the order at the address provided at the time of checkout. Any delivery that is refused and returned to the warehouse will be considered a “return” and you will forfeit the purchase amount, taxes and shipping costs.
